Das Bundesjustizministerium teilt dem WDSF mit Schreiben vom 19.05.2015 mit, dass Cpt. Paul Watson (Gründer der Sea Shepherd Conservation Society (SSCS) und Mitglied im Board of Trustees des WDSF) weiterhin bei einer Einreise nach Deutschland in Gefahr läuft, verhaftet zu werden. Am 22. April 2015 hatte sich das WDSF erneut an den Bundesjustizminister Heiko Maas (SPD) mit der Bitte gewandt, den Auslieferungshaftbefehl in Deutschland bei einer Einreise von Cpt. Paul Watson  nicht anzuwenden. Hier die abschlägige Antwort des Bundesministeriums:

Interpol extradition request for Paul Franklin Watson, born 02/12/1950 in Toronto, Ontario. Current whereabouts: France

Dear Mr Federal Minister of Justice,

I am writing to you as founder and managing director of the animal protection charity Wal und Delfinschutz Forum (WDSF). Since 2008 Mr Watson has been a member of the Board of Trustees (Advisory Board) at the WDSF. We intend to invite Mr Watson to Germany for the lecture programme.

Paul Watson was arrested at Frankfurt/Main airport on 13/05/2012 due to what was obviously a politically motivated extradition request via Interpol by Japan. The arrest of Paul Watson generated international outrage and was covered by the media. Beyond this, the Interpol extradition request by Costa Rica was rejected by the Higher Regional Court of Frankfurt/Main after the media releases. Nevertheless, the extradition request of Japan obviously persists, which Interpol published on the internet on 14/09.2012(see appendix).

A few days after his arrest Mr Watson was freed on condition of a security deposit offered by him to the amount of € 250,000.00. According to his own statement, Mr Watson was informed at the end of July that he would be arrested at one of his next registration dates and extradited to Japan.

Subsequently Mr Watson left Germany, whereby the Hessian Ministry of Justice, for integration and Europe informed the WDSF in a letter on 19/11/2012 that the state treasury conceded the expiring security deposit.

Despite the Interpol extradition request, in November 2013 the US authorised that Mr Watson may move freely in the US, but that he should not leave the country. On 14/02/2015 Paul Watson got married in Paris/France and since then is resident there. On 20/04/2015 the “The Japan Times” reported that the Japanese government turned to the French government in order to reapply for the extradition of Mr Watson (see appendix).

With respect to the decisions of the US and France, that Mr Watson may visit these countries without the Interpol extradition request being applied, we hereby request that Mr Paul Watson is allowed to enter and leave Germany with the permanent suspension of the previous Interpol extradition request by Japan. At the same time we request the assurance that Mr Watson is neither arrested at the border nor during a scheduled stay in Germany or is extradited to another country.

In correspondence with a press release of the “International Court of Justice “ of 31/03/2014, the European Court of Justice decided that the Japanese whaling program in the Antarctic (JARPA II) is not in conformity with the rules of the international convention for the regulation of whaling (see appendix). Two incidents in the Antarctic Ocean in February 2010 against a Japanese whaling ship are addressed in the reasoning of the Interpol extradition request. At the same time this concerns the “breaking into of a vehicle, damage to property and violent obstruction of business”. Likewise in its publication Interpol refers to a Red Notice of 07/12/2012 on request of Costa Rica in connection with the separate offenses charged. As you know, Red Notice is not an international arrest warrant. Correspondingly, the request to each member country relates to identification and localisation of the person concerned.

Mr Paul Watson, founder of the environmental organisation Sea Shepherd Conservation Society, assumes that he would not expect any constitutional procedure in the case of extradition to Japan. As the court judgement of the European Court of Justice also shows, the justification of Japan for whaling up to now in the Antarctic, which is supposed to be scientific, is advanced. It should be assumed from this that the reasons of the request by Japan with respect to Interpol are politically motivated.

Therefore, in the name of the Wal und Delfinschutz-Forum I would like to request your confirmation that Mr Paul Watson (native Canadian with Canadian and US passport) neither has nothing to fear legally when entering Germany, nor is denied entry or departure and that the Federal Ministry of Justice guarantees his intended stay in Germany without application of the Interpol extradition request. (WDSF - März 2013) Umweltschützer Paul Watson teilt uns auf Anfrage bezüglich der Aufhebung des Auslieferungs-Haftbefehls durch Costa Rica in Deutschland durch Antrag der Generalstaatsanwaltschaft beim Oberlandesgericht Frankfurt/Main mit, dass er aufgrund eines weiteren Auslieferungsersuchens  durch Japan über Interpol in Deutschland (und weiteren 189 Ländern, die Interpol angeschlossen sind) auch nach seiner "Flucht" weiterhin mit einer Verhaftung rechnen muss:

Die "Red Notice" bei Interpol ist zwar kein eigener Haftbefehl (Interpol verhaftet nicht selbst), sondern ein Ersuchen an das jeweilige Interpol-Mitgliedsland, die genannte Person zu identifizieren und ggf. vorläufig festzunehmen, um die Auslieferung im Rahmen der internationalen Gesetze zu überprüfen. In vorliegendem Fall liegt für Paul Watson bei Interpol immer noch ein Auslieferungsersuchen durch Japan vor, so dass Paul Watson jederzeit bei einer Einreise in Deutschland verhaftet werden könnte, um ihn einer Auslieferung nach Japan zuzuführen, wenn Japan die entsprechenden Auslieferungsunterlagen vorlegen kann. Costa Rica hat einfach nur verpasst, den Termin zur Vorlage der Unterlagen (27.02.2013) einzuhalten, so dass nur der Auslieferungshaftbefehl von Costa Rica auf Antrag der Generalstaatsanwaltschaft durch das Oberlandesgericht Frankfurt/Main gestoppt wurde.
Paul Watson könnte aufgrund des Auslieferungsantrags von Japan weiterhin in Deutschland verhaftet werden!!!

Wir rufen daher zu einer Protestaktion gegenüber Japan und dem Bundesjustizministerium auf:
